Sale of Property - Defensible Space Inspection

How it works

On and after 2021-07-01, if you sell property located in a high or very high fire hazard severity zone, you need documentation of a compliant Defensible Space Inspection. The page says that if your property is in the orange, pink, or red zones, an inspection will be required when selling the property.

What the service covers

This is a compliance inspection tied to Section 4291 of the Public Resources Code or local vegetation management ordinances. The district points homeowners to its "How To Make My Home Safe" checklist to see what items are reviewed during the inspection.

How to apply

For residences in the Monterey County Regional Fire District’s responsibility area, contact the administration office to schedule an appointment at (831) 455-1828. The current owner/seller or their realtor may make the appointment, and someone must be present during the inspection.

Timing and deadlines

A copy of the completed inspection report showing that the property has been inspected and passed must be from within six months prior to entering into a sales contract.

If the property does not pass

If the property does not pass on the first attempt, the inspector will explain what work is needed and schedule another appointment later. If the property still will not meet compliance with PRC 4291 standards or the district’s local vegetation management ordinance, the seller and buyer must enter into a written agreement under which the buyer agrees to obtain documentation of compliance within one year after closing escrow.
